David A. Bunis is a partner at Dwyer & Collora, LLP. In 2006, Mr. Bunis was named “Lawyer of the Year” by Massachusetts Lawyers Weekly. He was selected by his peers for inclusion in Super Lawyers in 2006, 2007, 2008 and 2009.  In addition, Mr. Bunis was named one of the top 100 lawyers in Masachusetts in 2009.

Mr. Bunis’ practice focuses on complex commercial litigation before state and federal courts, mediation and arbitration panels, government agencies and appellate courts.

Recent Cases:

  • Representation of national bank in $20.0 million negligent misrepresentation case against independent public auditor. Case arises from audit of borrower’s financial statements which concealed the existence of impaired leases and loans.
  • Representation of syndicate of banks in $50.0 million misrepresentation case against independent public auditor. Case arises from auditor’s failure to report frauds committed by officers and directors of publicly traded company.
  • Lead trial counsel responsible for $2.0 million award on behalf of one of the nation’s leading transportation companies.  The award followed a 15-day arbitration trial against a large fleet maintenance vendor that had been retained to service hundreds of diesel trucks in one of our client’s northeast delivery fleets. 
  • Lead trial counsel responsible for $7.2 million judgment on behalf of Fortune 100 Company involving misrepresentations contained in an opinion letter issued to our client. Recognized by Massachusetts Lawyers Weekly as one of the ten most important decisions of 2004.
  • Won dismissal of $300 million libel and defamation suit against our client, a multi-national internet service provider. Decision affirmed by the United States Court of Appeals for the First Circuit.
  • Won summary judgment in a case where the plaintiff had alleged that our client owed him more than $1.0 million in unpaid compensation and interest.
  • Representation of jet aircraft owner in litigation to revoke acceptance of $24 million corporate jet that suffered two in-flight engine failures.
  • Representation of national corporation in consumer protection litigation brought by Attorney General of Massachusetts. All claims dismissed against our client.
  • Representation of consortium of businesses in litigation alleging violation of statute prohibiting disclosure of data stored in Registry of Motor Vehicles computers. Argued case before Supreme Judicial Court of Massachusetts.
  • Won construction litigation after 13-day arbitration trial against general contractor.
  • Defense of corporate president against allegations involving non-payment of wages. All claims dismissed.
  • Defense of bank’s chief executive officer in class action securities litigation brought by former shareholders.
  • Representation of multinational corporation in securities litigation alleging misstatements and omissions in bond offering.
  • Won summary judgment for our client, a Boston law firm sued by a former employee for sexual harassment and discrimination.  Affirmed by the United States Court of Appeals for the First Circuit.
  • Defense of employer in discrimination litigation in federal court in New Hampshire. Defense verdict.
  • Defense of employer in whistle-blowing cases. All cases won or settled for nuisance value.
  • Successful prosecution and defense of dozens of non-compete, non-solicitation, and trade secret litigation matters on behalf of client in the employee placement field.
